IN JURISDICTIONS WHERE LIMITATIONS OF LIABILITY ARE RESTRICTED, GOFANS’ TOTAL CUMULATIVE LIABILITY, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL IN NO EVENT EXCEED THE GREATER OF (A) THE TOTAL FEES, IF ANY, PAID BY YOU TO GOFANS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED DOLLARS ($100). THE FOREGOING LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW, EVEN IF ANY LIMITED REMEDY IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE.

BY USING THE PLATFORM, YOU EXPRESSLY ACKNOWLEDGE AND ACCEPT THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE PLATFORM OR ANY RELATED SERVICES IS TO DISCONTINUE USE. The laws of the State of Delaware shall govern all matters arising out of or relating to these Terms, including, without limitation, its validity, interpretation, construction, performance, and enforcement.
